  I am very grateful to the hon. Member for giving notice of her point of order. As she says, a contingent liability of this size would normally involve the laying of a memorandum for a period of 14 sitting days before the guarantee is approved. The written statement made by the Minister for Energy on 1 September, when the House returned from the summer recess, sets out the reasons why the usual process could not be followed in this case. I suggest that the hon. Member might want to raise this matter privately with the Public Accounts Committee and the Energy Security and Net Zero Committee. I know that she is a doughty Member who will ensure that those concerns are raised in many other areas.

  Order. Before we begin today’s sitting, I regret to inform the House of the death of a former Member, Lord Field of Birkenhead. Frank navigated a career as a formidable MP, notably as the Minister tasked by Tony Blair with “thinking the unthinkable” on welfare reform. His sharp intellect and independent spirit made him a formidable campaigner against hunger, food poverty and climate change, and for numerous causes related to the Church of England. In recent years, I have been grateful for his championing of Parliament’s commitment to stamp out modern slavery from our supply chains. I am in no doubt that his efforts have saved many lives from this shameful criminal activity. He was one of a kind, and he will be sorely missed. [Hon. Members: “Hear, hear.”]

  Legislation will be introduced to strengthen the United Kingdom’s energy security, and reduce reliance on volatile international energy markets and hostile foreign regimes. This Bill will support the future licensing of new oil and gas fields, helping the country to transition to net zero by 2050 without adding undue burdens on households. Alongside this, my Ministers will seek to attract record levels of investment in renewable energy sources and reform grid connections, building on the United Kingdom’s track-record of decarbonising faster than other G7 economies. My Government will invest in Network North to deliver faster and more reliable journeys between, and within, the cities and towns of the North and Midlands, prioritising improving the journeys that people make most often.

  My Government will continue to lead action on tackling climate change and biodiversity loss, support developing countries with their energy transition, and hold other countries to their environmental commitments. The United Kingdom will continue to lead international discussions to ensure that Artificial Intelligence is developed safely. My Government will host the Global Investment Summit, the European Political Community, and the Energy Conference, leading global conversations on the United Kingdom’s most pressing challenges.

  New clause 6— Net zero power supply—

  “(1) It is the duty of the Secretary of State to ensure that the aggregate amount of net emissions of carbon dioxide and net emissions of each of the other targeted greenhouse gases associated with the supply of power in the UK in 2035 is zero.

  (2) The Secretary of State must by regulations provide for the means of calculation of net emissions of carbon dioxide and of each of the other targeted greenhouse gases for the purposes of subsection (1).

  (3) The means of calculation provided for in regulations under subsection (2) must be consistent with the means of calculation of the net UK carbon account for the purposes of section 1 of the Climate Change Act 2008.

  (4) For the purposes of this section a “targeted greenhouse gas” has the same meaning as given in section 24 of the Climate Change Act 2008.”

  This new clause is intended to provide for the UK’s power supply to be net zero by 2035.

  (d) define “low carbon electricity” in such a way that it includes renewable generation technology and may include other technology with extremely low carbon dioxide emissions,

  New clause 12— Prohibition on flaring and venting and enhanced measures to reduce fugitive methane emissions—

  (b) require monthly leak detection and repair inspections to reduce fugitive methane emissions,

  (c) require a measurement, reporting and verification process to quantify methane emissions, and

  (2) The Secretary of State must, in developing the Warmer Homes and Businesses Action Plan, consult the Climate Change Committee and its sub-committee on adaptation.”

  New clause 19 —Decarbonisation of capacity market—

  (b) the supply of renewable energy, and

  This new clause is a probing amendment to explore the potential of decarbonising the capacity market.

  (b) the impact of improving all homes to the highest possible Energy Performance Contract rating on energy bills and greenhouse gas emissions.”

  “(1) Within three months of the passage of this Act, the Secretary of State must publish and lay before Parliament a report setting out the financial, policy and other support that the Secretary of State plans to make available to widen the ownership of low carbon and renewable energy schemes and increase the number of such schemes owned, or part owned, by community organisations.

  (ii) the Urban Renewable Energy Fund, and

  New clause 25 —Investment protection agreements and climate change targets—

  (ii) an assessment of the risks they pose to the Secretary of State fulfilling duties in this Act with regard to the achievement of targets set by the Climate Change Act 2008.”

  (b) advancement of the UK’s climate change commitments, including—

  (i) the target for 2050 set out in section 1 of the Climate Change Act 2008, and

  (c) facilitation of a just transition for oil and gas workers and communities.

  (f) relevant industry representatives of petroleum and renewable energy businesses supporting the transition away from fossil fuels, and

  (5) Relevant climate and environmental organisations and representatives under subsection (4(e)) must include the Climate Change Committee.”

  This new clause would amend the Petroleum Act 1998 to remove the principal objective of maximising the economic recovery of UK petroleum and replace it with a new principal objective to deliver a managed and orderly phase down of UK petroleum, advance the UK’s climate targets, and support a just transition for oil and gas workers.

  This new clause probes the potential of decarbonising the capacity market.

  (2) In preparing the Energy Demand Reduction Delivery Plan under subsection (1), the Secretary of State must consult the Climate Change Committee.

  (a) a quantitative assessment on the role of energy demand reduction in meeting the United Kingdom's carbon budgets and the 2050 net zero target;

  in line with the UK’s carbon budgets and the 2050 net zero target; and

  (5) The Climate Change Committee must evaluate, monitor and report annually on the implementation of the Energy Demand Reduction Delivery Plan.”

  New clause 35 —Energy decarbonisation for homes: local authority funding—

  “(1) The Secretary of State must, within six months of the date on which this Act is passed, carry out and publish an assessment of the benefits of providing long-term predictable funding to local authorities for the purpose of energy decarbonisation for homes in their local authority area.

  (2) The assessment under subsection (1) must include an assessment of the likely impact of decarbonisation funding on—

  (4) Regulations under subsection (1) must provide that any nationally significant infrastructure project of over 50mw unable to demonstrate beyond reasonable doubt that its goods, or materials in the goods, were not mined, produced, or manufactured wholly or in part by forced labour must be recommended for rejection by the Planning Inspectorate upon the submission of the Inspection to the Secretary of State for Energy Security and Net Zero.

  (c) a whole energy market analysis to establish and quantify the potential contribution of tidal range power to the decarbonisation of the United Kingdom’s energy system with particular reference to the value of predictable, flexible energy generation near centres of increasing demand and the potential of operational tidal range projects to bypass major grid barrier issues and enable a stable, operable, and secure decarbonised energy grid;

  (d) define “low carbon electricity” in such a way that it includes renewable generation technology and may include other technology with extremely low carbon dioxide emissions,

  New clause 59 —Decarbonised electricity supply by 2030—

  “(1) It is the duty of the Secretary of State to ensure that the supply of electricity in the UK is decarbonised by 2030.

  This new clause is intended to provide for the UK’s electricity supply to be decarbonised by 2030.

  (2) The Secretary of State must, in developing the Warmer Homes and Businesses Action Plan, consult the Climate Change Committee and its sub-committee on adaptation.”

  This amendment allows persons with a CO2 storage licence from the North Sea Transition Authority to operate a geological storage site for CO2 disposal, as per current legislation in the Energy Act 2010.

  This amendment would exclude from the requirement to have an economic licence, all forms of transportation where competitive markets are more likely to develop than monopolies e.g. shipping, rail or road. It would also enable investment in private spur connections to the regulated CO2 network.

  Carbon dioxide transport by ship is almost certain to be a part of the Scottish Cluster and subsequent phases of other CCUS clusters and this amendment makes explicit that transportation by ship or other means would be included in the financial assistance available under clause 103.

  (a) develop, promote and implement a comprehensive national strategy for carbon capture and storage (CCS) for the energy industry to deliver the emissions reductions required to meet the fifth and subsequent carbon budget, as advised by the committee on climate change;

  (b) develop that strategy in consultation with HM Treasury, the Department for Business, Innovation and Skills, the Oil and Gas Authority, the National Infrastructure Commission, energy intensive industries and other relevant stakeholders including the CCS industry; and

  (b) a funding strategy for implementation including provision of market signals sufficient to build confidence for private investment in the CCS industry;

  (d) priorities for such action in the immediate future as may be necessary to allow the orderly and timely development and deployment of CCS after 2020.

  New clause 8— Decarbonisation target range —

  “(2) The Secretary of State must by order (“a decarbonisation order”) set a decarbonisation target range, which shall be reviewed annually thereafter.”

  “(5) The decarbonisation order shall be made within six months of the adoption of the fifth carbon budget set by virtue of the duty of the Secretary of State under section 4 (2) (b) of the climate Change Act 2008.””

  In section 27 (net UK carbon account) of the Climate Change Act 2008, after subsection (3) insert—

  ‘(1) The Climate Change Act 2008 is amended as follows.

  3A Net UK carbon emissions target: zero emissions year

  ‘(1) The Secretary of State shall set a date by which net UK emissions must be zero or lower (“the zero emissions year”) by order no later than 12 months from the date on which the Energy Act 2016 comes into force.

  (2) It is the duty of the Secretary of State to ensure that the net UK emissions for the zero emissions year and each year thereafter is zero or less.

  (3) If an annual statement of UK emissions under Section 16 for a year after the zero emissions year shows that net UK carbon emissions are more than zero, the Secretary of State must, as soon as reasonably practicable lay before Parliament a statement which—

  (4) The Secretary of State may by order amend the zero emissions year.

  (a) scientific knowledge about climate change, or

  (7) Before laying a draft of a statutory instrument under subsection (6) the Secretary of State must obtain, and take into account, the advice of the Committee on Climate Change.

  (9) If an order under subsections (1) or (4) sets or amends the zero emissions year in a way that is different from the recommendation of the Committee under subsection (7), the Secretary of State must lay a statement before Parliament explaining his reasons for that decision.

  (10) When the Secretary of State comes to any decision under this section, or the Committee on Climate Change considers its advice in relation to any such decision—

  New clause 12— Strategy for a Just Transition away from fossil fuels —

  ‘(1) The Secretary of State must develop a comprehensive national strategy for the UK energy sector to move away from fossil fuels and towards 100% renewable energy by 2050, under the framework of a Just Transition outlined in subsection (5)(a).

  (3) The transition must ensure that UK carbon emission reductions make a fair contribution to the goals set out in the 2015 Paris Climate Change Agreement.

  (c) the Committee on Climate Change,

  (g) the renewable energy industry,

  (a) the adoption of the principles of Just Transition set out by national and international trade unions, including—

  (d) cooperation with EU institutions and EU member states to embed the principles of Just Transition at EU level.”

  This new clause would require the Secretary of State to develop a strategy for a Just Transition away from fossil fuels and towards a renewable energy future.

  ‘(1) By June 2017, the Secretary of State must develop a comprehensive strategy for the Department of Energy and Climate Change to incentivise the competitiveness of UK-registered companies in bidding for supply chain contracts associated with the decommissioning of oil and gas infrastructure (the strategy), which shall be reviewed annually thereafter.

  (6) The Secretary of State must, within one year of each order setting a carbon budget under section 8(1) of the Climate Change Act 2008, review the plan prepared and published under this section.

  ‘(1) Within 12 months of this Bill receiving Royal Assent the Committee on Climate Change shall advise the Secretary of State about—

  (a) the scale of action needed in local authority areas to help meet UK Climate Change Act carbon budgets;

  (b) climate mitigation and adaptation policies that are effective when locally co-ordinated by councils.

  (c) local renewable energy generation;

  (3) The Committee on Climate Change may advise the Secretary of State on local level adaption to climate change to ensure that individual local carbon budgets are both appropriate for the circumstances of different local areas that the totality of all local carbon budgets is consistent with the requirements of subsection (1)(a).

  (4) The Secretary of State must lay before Parliament a response to the advice given by the Committee on Climate Change under subsection (1) or (2), within six months of receiving the advice.

  (a) “budgetary period”, “carbon budget” and “national authorities” have the same meaning as in Part 1 of the Climate Change Act 2008;

  New clause 4— Climate change strategy for local authority areas —

  ‘(1) Local authorities must develop and promote a climate change strategy for their local area.

  (2) In preparing the strategy, local authorities must take into account any advice given by the Committee on Climate Change on local action to meet carbon budgets.

  (4) Local authorities must publish and promote their local climate change strategy, publish an annual report on progress towards carrying out the strategy and engage with local citizens and community groups.

  (5) The Secretary of State must work with local authorities and the Local Government Association to assist them in producing and implementing their climate change strategies, taking into account any relevant advice from the Committee on Climate Change.’.

  (i) the carbon budgets established under the Climate Change Act 2008; and

  (a) the carbon budgets established under the Climate Change Act 2008, and

  ‘(1A) In setting out the extent to which the green deal plans under Chapter 1 of Part 1 and energy company obligations have contributed to the Secretary of State fulfilling the duty under section 4(1)(b) of the Climate Change Act 2008 (carbon budgeting), the Secretary of State must if necessary explain why the appropriate contribution has not been made and the additional measures he will bring forward.’.

  (6) An energy conservation authority must also consider whether, as a means of assisting the Secretary of State to fulfil his duty pursuant to the Climate Change Act 2008, it would be cost effective to draw up a sustainable energy plan for its area.

  (c) “a sustainable energy plan” is a plan promoting energy from sustainable or renewable sources.’.
